Terms: You must read this because it creates a contract
- Definitions:
"WE", "US", "OUR", means "WWW.JOHNFOOTE.CO.UK", "JOHN FOOTE THE INTENSIVE DRIVING SCHOOL", "JOHN FOOTE" "JOHN FOOTE DRIVING"
- "ASSOCIATE/S"
"INSTRUCTOR/S", "DRIVING INSTRUCTOR/S", means our "FRANCHISED INSTRUCTOR/S"
- "FRANCHISED" means a self employed driving instructor
paying us either a fee, commission or both to display and use our driving school logos for the purpose of giving driving lessons. "DSA" means the
Driving Standards Agency
- "YOU", "YOUR" means "YOU"
- "DSA" means "Driving Standards Agency"
About this contract:

The contract between us and you is deemed binding once you accept the
driving test booking date and pay for the course and Driving
Test using Google Checkout ™ via our website
- If you book your own Driving Test the contract comes into
force once you book and pay for an intensive course using
the method described above
- In any event, booking an intensive driving course deems
that you have accepted our terms and conditions
- You have a 7 day "cooling off" period from the moment you make your payment via Google Checkout™
- If your Driving Test is due
within 7 days of your original booking we cannot apply a "cooling off" clause. In this event you should think carefully before making a booking with us
About your course and how it is chosen:
- This is not a car-sharing course
- The same fully qualified Instructor will teach you throughout your course
- In the unlikely event of Instructor ilness or mechanical failure of the tuition vehicle,
John Foote reserves the right to substitute an Instructor or vehicle to start, continue or complete the training course
- All tuition vehicles are insured and dual
controlled and remain the responsibility of the Instructor
- When you told us about your driving skills
we either accepted your choice of course (based upon the skills you described to us) or you took advantage of our two hour assessment
- We cannot foresee or guarantee the
result of your driving test, whether you selected your course or took an assessment with us
- John Foote strongly recommends an assessment lesson prior to your intensive
course
- If, for any reason, you reduce the number of agreed hours you must accept full responsibility for your decision.
We will not refund any hours paid but not taken if you
choose to reduce your agreed course length
- If we recommend or you request further tuition you may purchase extra lessons currently charged at £25.00 per hour
- This rate may vary from time to time.
Any variations to our rates will be published on our website
What you need to bring on the first day of your course and the
day of your Driving Test:

1. Both parts of your licence, photo card and A4 driving licence counterpart plus (when applicable) your theory test certificate
- 2. The DSA confirmation email showing your test date and time

3. If you hold an "old fashioned" paper licence, bring photographic
identity. See the DSA confirmation email for suitable identity
documents. Your Passport is a suitable example. Please ask your
Instructor about other suitable forms of identity if you do not have
a Passport.

4. Glasses or contact lenses prescribed for driving

Items 1 - 4 will also apply to your test day
- The DSA will cancel your
Driving Test if you cannot comply with any or all of items 1 - 4 shown above
- We cannot offer you any refund if this happens
- The onus is upon you to prove your identity on the day of your
Driving Test
How your payments become due:
- The full payment as
shown on the website becomes due within 3 working days of the Driving Test "booking date"
- For the avoidance of doubt, the "booking date" is the date
WE book your Driving Test and NOT the date of the DSA driving test
- We reserve the right to change, at any time and without notice, our methods of payment
- If a payment is not received within 3 working days of any request for payment we reserve the right to cancel the driving test and course
- We will tell you by email
or phone before we do this
- Payment is only acceptable via Google Checkout™
About your Instructor:
- Associates of John Foote are self-employed
DSA Approved Driving Instructors (ADI's) and the first day of your course transfers the contract to
a John Foote
associate
- John Foote cannot be held responsible for the actions of an associate
- John Foote does not use the services of trainee driving instructors
or sub contracted instructors
- All instructors
/ associates are fully qualified and approved by the DSA and will have been on the DSA register for a minimum of 5 years
and have undergone at least 1 DSA Check Test
Who can cancel your course?
- You may cancel your intensive course once started and we will refund any hours paid, but not taken, at our current refund rate of £10.00 per hour
- We can vary the refund rates at any time
and we will publish any variation to this rate on
this page
- We may not be able to refund the DSA
Driving Test fee if we have less than 10 (ten) clear working days before the
Driving Test due date
- A Saturday is deemed to be a working day unless preceeded
or suceeded by a Public Holiday
- You may cancel your intensive course up to 10 clear working days before the Driving Standards Agency's notified cancellation date. We will refund you the
DSA driving test fee, if we paid it, less a 25% administration charge.
We need 10 (ten) clear working days to do this
The
25% administration fee equates to the course value, less the DSA test fee, shown on our website
For the avoidance of doubt, we will refund 75% of the course fee.
We will refund the DSA test fee in full if we have 10 (ten)
clear working days in which to do so-
We can cancel your course if we have made every effort to contact you but without success.
The next point shows how we will attempt to contact you
- We will attempt to contact you by either email, text message or voice mail, using the
contact details you gave us before we do this

We reserve the right to clear payments before making any refund
- Any payments can only be refunded to the original credit or debit card holder
Your DSA Driving Test:

We can postpone or change the date ofyour driving test if you fail to reach a standard that we consider acceptable to the Driving Standards Agency
- We will tell you in sufficient time if we
feel this is necessary and we must retain the right to do this
in the interest of public safety
- In any event we will work with you to arrange further remedial training and re-apply for your Driving Test
What happens if the Driving Test date is changed?

It is extremely unlikely that we will change the test date. We have outlined in the previous paragraph "Your DSA Driving Test" why we might do this

The DSA can and does change or cancel Driving Test dates often with little or no warning
- Weather, sickness and administrative errors are all
DSA reasons for cancellations and
neither John Foote nor our Instructors can be responsible
for the actions of the DSA
- The DSA should tell you if it changes your test date. You must tell us
- If the DSA cancels your Driving Test we will endeavour to make available the same Instructor
and tuition vehicle for your new test date. We cannot guarantee this
- We may need to substitute an alternative Instructor
and tuition vehicle
The Driving Standards Agency and you:

We have absolutely no control over any actions or decisions which
either the DSA or its Examiners may take
- When we book your driving test we act as a third party between you and the DSA and we cannot be held liable for any apparent breach of contract by the DSA
- Though we will do everything we can
to help resolve a problem, you should remember that the contract for the driving test is between you and the DSA
- The DSA can and does use the Data Protection act to avoid discussions with any third party
