Terms: You must read this because it forms the contract between us
The contract between us comes into force once you accept the driving test booking date. When you accept the driving test date we assume your acceptance of our terms and conditions.
If you book your own driving test the contract comes into force once you book
an intensive course with us
In any situation, booking an intensive driving course deems that you have accepted our terms and conditions. A booking is defined as an acceptance by you either by email or telephone to johnfoote.co.uk . Subsequent confirmation; either by
email or telephone directly with www.johnfoote.co.uk or by email with a staff instructor appointed by www.johnfoote.co.uk is deemed acceptance of the contract between us
You should read carefully our terms, because once a payment is made to our Instructor a binding contract is created between you and your Instructor
About your course and how it is chosen
This is not a car-sharing course
The same fully qualified Instructor will teach you throughout your course. In the unlikely event of Instructor sickness or mechanical failure of the tuition vehicle,
www.johnfoote.co.uk reserves the right to substitute an Instructor or vehicle to start, continue or complete the training course. All tuition vehicles are insured and dual
controlled.
When you told us about your driving skills
We either accepted your choice of course (based upon the skills you described to us) or you took advantage of our two hour assessment. We cannot foresee or guarantee the
result of your driving test, whether you chose your course or took an assessment with us. www.johnfoote.co.uk strongly recommends an assessment lesson prior to your intensive
course
If you subsequently reduce the number of agreed hours, you must accept responsibility for your decision, we will refund any hours paid, but not taken, at our current refund rate
of £10.00 per hour. This rate may vary from time to time. Variations to our rates will be published on this page
If we recommend further tuition your decision to purchase extra lessons is at your discretion, currently charged at £28.95 per hour. This rate may vary from time to time.

What you need to bring on the first day of your course:
1. Both parts of your licence, photo card and A4 driving licence counterpart plus (when applicable) your theory test certificate
2. The DSA confirmation letter showing your test date and time
3. If you hold an "old fashioned" paper licence, bring photographic identity. See the back of your DSA confirmation letter for suitable identity documents. Your Passport is a
suitable example. Please ask your Instructor about other suitable forms of identity if you do not have a Passport. The onus is upon you to prove your identity on the day of your
test
4. Glasses or contact lenses prescribed for driving
5. Any balance of payment that might be due. See below
6. Initial Payment email receipt (if applicable)
Items 1 - 4 will also apply to your test day
The DSA may cancel your test if you cannot comply with any or all of items 1 - 4 shown above. We cannot offer you any refund if this happens

From time to time we may request the Total Cost in advance. We will tell you if we need to do this
About the payments:
Payment procedure is enforced at the discretion of johnfoote.co.uk. We may, on occasions choose to accept full payment on the day the course begins. Changing our payment method does not alter any other terms or conditions
How your payments become due
The Initial Payment (if we enforce it) becomes due within 10 working days of the driving test booking date. We will email you detailing the amount
payable and how to pay it
We reserve the right to change, at any time and without notice, our methods of payment
If a payment is not received within 10 working days of our email we reserve the right to cancel the driving test and course. We will tell you by email before we do this
If the Balance of payment is due, it is payable to your Instructor on the FIRST DAY of your course. You must speak to your Instructor before you start your course if you wish to pay by cheque. You should be aware that, in some circumstances, you might be asked to provide a cheque drawn against a Building Society. If any payment is subsequently dishonoured we reserve the right to cancel both the driving test and course without notice and adopt any reasonable methods to recover any expenses incurred
About you and your Instructor
Associates of www.johnfoote.co.uk are self-employed and your Balance of Payment subsequently transfers the contract to our
associate. www.johnfoote.co.uk cannot be held responsible for an associate.
Who can cancel your course?
You can cancel your intensive course once started and we will refund any hours paid, but not taken, at our current refund rate of £18.00 per hour. We will not refund the
Initial Payment. We can vary the refund rates at any time; we will publish any variation to this rate on this page
You can cancel your intensive course up to ten working days before the Driving Standards Agency's notified test cancellation date. We will refund you the DSA driving test
fee, if we paid it, we will not refund the administration charge. You must notify us by telephone and confirm by email
Saturday is deemed to be a working day
We can cancel your course if we have made every effort to contact you but without success. We will contact you by either email, text message or voice mail, we will use the
methods of contact made available to us by you.
If you cancel your intensive course after the Driving Standards Agency's notified cancellation date, but before your intensive course starts, we will not refund the Initial
Payment. No further charges will be made
We reserve the right to clear cheques before making any refund
We can postpone your driving test if you fail to reach a standard that we consider acceptable to the Driving Standards Agency. We will tell you in sufficient time if we
feel this is necessary. We must retain the right to do this; we will refund any lessons paid, but not taken, at the hourly rate we charged you. Your hourly rate might
differ from that currently shown on www.johnfoote.co.uk. In any event we will not refund the Initial Payment or DSA test fee
What happens if the test date is changed?
It is extremely unlikely that we will change the test date however, we will tell you before doing so. In this event you may cancel the course and receive a refund of any
payments you have made to us, less the DSA test fee if paid by us, unless you have reimbursed us the DSA test fee
If you change the test date you must contact us before you do so. We will tell you our availability of future course dates. If we cannot carry out your course (or you
decline our availability of future course dates you will be entitled to any refund due, less the Initial Payment
If you fail to tell us, we may not be able to carry out your course, if we cannot you will not be entitled to a refund
The DSA will always tell you if they change the test date. You must tell us. If the DSA cancels your driving test we will endeavour to make available the same Instructor
and tuition vehicle for your new test date. We cannot guarantee this. We will charge our published intensive course rate if you require additional instruction prior to your
new driving test date
The Driving Standards Agency and you
When we book your driving test we act as agent between you and the DSA, we cannot be held liable for any breach of contract by the DSA. Though we will do everything we can
to help resolve a problem, you should remember that the contract for the driving test is between you and the DSA
